Confidentiality (DE)

This document supplements the contract between Agent On Demand and customers based in Germany and applies in addition to the GDPR and the Bundesdatenschutzgesetz (BDSG).

Agent On Demand, its employees and its collaborators are bound to secrecy regarding the customer's data and confidential information. The obligation continues even after termination of the contractual or employment relationship.

• Prohibition on processing, disclosing or making data accessible without authorisation
• Prohibition on using data for own purposes
• Obligation to report any suspected breach immediately

The customer's technical, commercial and organisational information is treated as a trade secret under the Geschäftsgeheimnisgesetz and protected with appropriate measures.

In providing cloud telephony services, the confidentiality obligations for communications are respected. Calls are not recorded as audio; their content is processed to produce text transcripts after callers have been informed.

The confidentiality obligation does not apply to information that is publicly available or whose disclosure is required by an authority or by law; in that case the customer is informed in advance, where permitted.

Unless otherwise agreed in writing, German law applies to this document for German customers; the mandatory provisions of the main contract remain unaffected.
